Many homeowners wonder what their rights are after receiving a violation notice from their Homeowner's Association (HOA). In fact, many HOAs rely on homeowner ignorance to further deprive homeowners of their rights.

Did you know that before any penalties can be assessed against you, the HOA is required to provide you with a notice of a hearing? While this may sound ominous, the hearing is just a formal record to discuss the supposed violation, proposed penalties and potential remedies. There are a number of specific requirements for the notice to be valid, including that it must specify when and where the hearing will be held and the purported violation(s). Often, the hearing will be held around the time of your HOA's next board meeting. During the hearing, you have the right to submit evidence and defend yourself against the HOA's accusations.
